In addition to contract claims, Deceptive and Unfair Trade Practices Act (FDUTPA) claims are often also pled in commercial disputes as a catchall for what a party perceives as bad behavior by the other. Because FDUTPA claims come with the possibility of the winner recovering their attorneys' fees from the other side, they are sometime the most potent claims at issue.  Be sure your mediator understands the nuances of these claims.
