Following a five-week bench trial at which I testified for a full day, the court adopted my opinions that Squire Sanders was not negligent in its handling of the complex patent litigation and re-exam and that its fees were reasonable. The court agreed with my refutation of more than 70 malpractice allegations advanced by the opposing expert. Opposing counsel described my fee report on the record as "meticulous" and said his cross-examination would therefore be extremely limited.
In its written order awarding over $4.5 million in attorneys’ fees, the court found my analysis of the lawyers, the rates and the issues in the case "spot on." The court continued: "Mr. Matulis personally reviewed literally thousands of billing entries since the beginning of this now eight-year case. His testimony and report was thoughtful, comprehensive, and incredibly detailed and balanced. Much of the substance of his methodologies have been adopted by the order of this Court."
In awarding attorneys’ fees, the court largely accepted my proposed partner hourly rates, finding them consistent with the market despite being much higher than rates previously approved in comparable published IP fee decisions in the Middle District of Florida.
Prepared an extensive expert report and testified at deposition concerning the reasonableness of attorneys’ fees and litigation expenses incurred defending a heavily litigated 12-patent infringement action brought by Sprint Communications. The case was litigated over the course of eight years and involved discovery, a three-week trial, appeal, and a petition for certiorari to the U.S. Supreme Court.
Prepared extensive expert reports and testified at deposition in two related indemnification cases arising from Charter’s defense of a complex 15-patent infringement case that was litigated through the eve of trial, followed by extensive settlement negotiations. My analysis addressed the reasonableness of defense fees and expenses and the allocation of a global settlement with Sprint Communications among five separate litigations to determine the amounts attributable to the indemnified claims.
Prepared expert report and testified at deposition in a related indemnification dispute involving the same underlying 15-patent litigation and global settlement described in the Sonus matters above. The assignment involved the same analysis of defense fees and expenses and allocation of the settlement among five related lawsuits, but concerned a different indemnitor and its share of the amounts attributable to indemnified claims.
